In the 2018 case South Dakota v. Wayfair, Inc., the Supreme Court held that states must charge sales tax on purchases made from out-of-state sellers, even if the seller does not have a physical presence in the taxing state. UntilGone.com, along with other eCommerce retailers, is required by law to collect sales tax on orders from customers in many states around the country.
